DMCA Policy

PLEASE READ THIS DMCA POLICY CAREFULLY BEFORE USING THIS WEBSITE. THIS DOCUMENT SETS FORTH YOUR RIGHTS AND OBLIGATIONS UNDER THE DIGITAL MILLENNIUM COPYRIGHT ACT (“DMCA”), TITLE 17 OF THE UNITED STATES CODE, AND OTHER APPLICABLE INTERNATIONAL COPYRIGHT LAWS AND REGULATIONS. BY ACCESSING, BROWSING, OR OTHERWISE USING THIS SITE, YOU EXPRESSLY AGREE TO COMPLY WITH THE POLICIES AND PROCEDURES DESCRIBED BELOW. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE USE OF THE SITE.

Acceptance of Terms

This DMCA Policy (“Policy”) governs how this website (“Company”) receives, evaluates, and responds to claims of alleged copyright infringement. By using the site, you acknowledge that you understand and accept the responsibilities imposed on both copyright owners and service providers under the DMCA.

The Company reserves the right to revise this Policy at any time. Updates will take effect immediately upon publication on this page. Continued use of the site constitutes binding acceptance of such revisions, whether or not you have reviewed them.

Purpose and Scope

The DMCA, enacted in 1998, provides a structured mechanism for copyright holders to request the removal of infringing content hosted by online service providers. As a service provider, the Company does not adjudicate ownership disputes but acts in good faith to comply with validly submitted notices and counter-notifications.

This Policy applies to all users who upload, publish, distribute, or otherwise make material available on this site, and clarifies the rights of copyright holders as well as the responsibilities of users.

Filing a DMCA Takedown Notice

If you believe that your copyrighted material has been reproduced, displayed, or distributed without authorization, you must submit a DMCA Takedown Notice to our Designated Agent. To be effective under Section 512(c)(3) of the DMCA, your notice must include, at a minimum:

  • A physical or electronic signature of the copyright owner or authorized representative.
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  • Identification of the allegedly infringing material, including sufficient information for us to locate it on the site.
  • Your contact information (full legal name, mailing address, telephone number, and email address).
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or by law.
  • A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the rights holder.

Notices lacking complete information may be deemed invalid. We reserve the right to request clarification before taking action.

Counter-Notification Procedure

If your content has been removed due to a DMCA Notice and you believe this was an error or misidentification, you may file a Counter-Notification. To be valid, your Counter-Notification must include:

  • Your physical or electronic signature.
  • Identification of the removed or disabled content and its prior location on the site.
  • A sworn statement, under penalty of perjury, that you believe in good faith the content was removed as a result of mistake or misidentification.
  • Your full contact information, including name, address, telephone number, and email.
  • A statement consenting to the jurisdiction of the federal district court in which you reside (or where the Company is located if outside the U.S.), and agreeing to accept service of process from the original complainant or their agent.

Once received, we will forward your Counter-Notification to the original complainant. If no legal action is initiated within 10–14 business days, we may, at our discretion, restore the removed content.

User Obligations and Representations

By uploading or publishing material on this site, you represent and warrant that you have full rights, licenses, or permissions to do so. You agree not to post content that infringes upon third-party copyrights, trademarks, or other intellectual property rights.

Users who repeatedly upload infringing content may face suspension, permanent account termination, or referral to appropriate legal authorities.

Misrepresentation and Liability

Submitting knowingly false DMCA Notices or Counter-Notifications is a violation of Section 512(f) of the DMCA. Any party who misrepresents material or activity as infringing may be held liable for damages, including costs and attorneys’ fees.

The Company expressly reserves the right to pursue remedies against parties who abuse the DMCA process.

Repeat Infringers

We maintain a strict policy for repeat infringers. Accounts that receive multiple valid DMCA complaints will be permanently terminated, and all related content may be deleted without notice.

Determinations regarding repeat infringement are made at the sole discretion of the Company, taking into account frequency, severity, and context.

Fair Use and Legal Exceptions

Certain limited uses of copyrighted materials may qualify as “fair use” under U.S. copyright law for purposes such as criticism, commentary, news reporting, education, scholarship, or research.

Users are advised that claiming fair use is a nuanced legal defense, not an automatic exemption. The Company does not provide legal advice, and users should seek independent counsel if uncertain about their rights.

Designated Agent Information

All DMCA Notices and Counter-Notifications must be directed to our Designated Agent. Contact details are published in the legal section of this website. Only properly formatted communications related to copyright infringement will be processed.

Record Retention

We maintain records of all DMCA Notices, Counter-Notifications, and remedial actions taken. Such records may be retained for legal compliance, defense in litigation, or monitoring repeat infringers. Data is stored in accordance with applicable privacy and data protection laws.

Limitation of Liability

The Company acts in good faith to comply with DMCA obligations. We disclaim liability for any damages arising from content removal, account suspension, or other enforcement actions under this Policy.

To the fullest extent permitted by law, we further disclaim liability for indirect, incidental, or consequential damages.

International Application

While the DMCA is a U.S. statute, this Policy applies to all users worldwide. Non-U.S. users acknowledge that we may remove content in order to comply with U.S. law, even if local legal standards differ.

Users outside the U.S. also acknowledge that disputes may be resolved under U.S. jurisdiction as described herein.

Preservation of Rights

Nothing in this Policy limits our right to independently remove content, suspend access, or take other measures to protect the integrity of our platform and the rights of third parties, regardless of DMCA processes.

Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the jurisdiction where the Company is registered, without regard to conflict-of-law rules.

All disputes shall be subject to the exclusive jurisdiction of courts located in such jurisdiction.

Policy Updates

We reserve the right to amend or replace this DMCA Policy at any time to reflect legal developments or operational requirements. Updates take effect immediately upon publication, and users are responsible for reviewing this Policy periodically.
